In San Francisco, all artwork on City property, whether or not it was acquired prior to the establishment of the Commission in 1932, is by City Charter under the Arts Commission’s jurisdiction (other than work owed by the City’s Fine Arts Museums.)  If we were to deaccession something that predates the Commission, we would look to how it came into the city’s possession, i.e. a bequest, WPA etc. to see if there were terms that we needed to honor.  In our recent decision to remove the “Early Days” figurative grouping from the Pioneer Monument (commissioned by the City as the result of the bequest from James Lick), we looked at the terms of the bequest.  We also looked at whether or not the Calif. Art Preservation Act impacted our ability to remove this grouping to determine that protection of the work had expired under that statute (the artist had been deceased for 70+ years). The Commission then determined that the Arts Commission had the authority to remove “Early Days” based on our Charter authority to manage the Civic Art Collection.

These are all really great responses. How are folk handling deaccessions of artworks that predate the agency where there is no contract on file and/or the artist is no longer living?
