This is a really interesting issue. Deaccession has been a concern for museums and others for awhile, especially if the art or funds came from a private donor. Public art being funded by (usually) tax dollars that came from citizens (the public) is new territory.
Questions abound. Will the private developer agree to take on all maintenance and preservation? What happened if the developer wants to deaccession, does the work come back to the public by presale covenant?
Do the proceeds from any sale go back to the public art fund for future preservation or purchase.
I hope others have answers because this opens a pandora’s box that could turn out to be an truly interesting take on public/private partnerships.
