Our situation was that a private donor gifted the art to the city, and the land owner gifted the easement. The city then became owner of the artwork and has the right to move it if needed. Everyone was happy with that arrangement and it gets around any issues of using public funds in private spaces.

We tried the attached easement drafted by the Legal Department but, in the end, the city refused to allow tax dollars for public art to be used to beautify private property.
