In Albuquerque, we do not have a special permit for use of land for public art. We had a very interesting case about 10 years back where the artwork, see attached photo, that opponents claimed to be in violation
of a “viewshed” designation, but that was denied and actually resulted in an administrative determination, and executive memo, stating that Public Art is not a zone-able land use classification.
We do however, have to get (only) excavation permits for any foundation work that is done below grade. We have also very successfully negotiated that the cost of the excavation permit is only based on the amount
of the foundation costs and not the entire artwork or commission/installation costs. This has resulted in a much, much lower cost for permitting actual foundation construction that is part of the artist/contractor’s responsibility to pay when they get the
permit.
We do have to get barricades/lane closure permits ~ except for when the public safety department thinks that public art is so cool they assign police cars to block the road for us…;o).

Hey Mandy,
Public Art is not defined in land use code here. Most of the public art related codes are within the Administrative code.
All projects require the proper approvals and permits – usually through the Buildings department for more permanent installations. Frequently these permits are processed as part of the larger construction project, but a single public art
installation may require a stand-alone permit. Our office does have to pay for those. There is not a “Public Art Permit” here.

I’m interested in collecting a quick survey of permitting and land use definitions as they relate to public art, and will happily share responses once I’ve received them. My questions for you are:
- In your municipality or where you’ve received commissions, is public art defined in any capacity within the municipality’s land use code?
- If yes, please provide the language.
- In your municipality or where you’ve received commissions, do public art commissions require city permitting?
- If yes, is there a public art permit?
- If yes, what permits do you need to obtain?
- If yes, who shoulders the permit costs?
