Dear Pax,
I think your situation is a little different from ours in that SF Arts Commission is a city agency and our commissioners serve at the Mayor’s pleasure. We have artists on the Commission and for their tenure
they may not apply to SFAC public art projects. Conflict of interest is defined as having a potential financial conflict or a family relationship. Our selection panels are made up of 1) an Arts Commissioner, 2) a representative of the client agency 3) a
community representative, 3) three arts professionals 4) the project architect (optional). This is an ad hoc panel; the arts professionals are different each time. Obviously, artists cannot serve on a panel for projects for which they are an applicant.
Not sure what you mean by sharing information that is not being shared publicly, but as a city agency in a state and city with strict open government laws, there are no secrets. All of our meetings (including
selection panel meetings) are noticed and open to the public. Any documents produced, (from review score sheets to the scribbles on my notepad) are considered “public documents” and copies may be requested by any member of the public.

Dear Public Art Network listserv members,
We have a nascent public art program, which is administered by a Public Art Advisory Panel. We came to the realization a few months in that two of the members of the panel brought in for their expertise in
structural engineering and landscaping respectively, would present a conflict of interest for the businesses where they work for projects we are planning, and they stepped down. We’ve replaced them with city employees.
The question now is how do we deal with having artists on the panel? Do we have to have artists sign a waiver that they will not apply to any projects for a certain amount of time during and after their tenure
on the panel? What about sharing information with other artists? Do we need to have them agree not to share any information that is not being shared publicly? How does that work?
I would love some best practices guidance from folks out in the field.
