Yes, the film compliance liaison should know that they need to secure approval of the copyright holder of the artwork to be included, which is usually the artist, not the commissioning agency. Because we are
the go to entity for helping them identify who the artist is, we are aware of the production but are not required to give permission. If the film company cannot secure the copyright holders approval/agreement then they are fully responsible for either choosing
a different location to shoot, removing or obscuring the art in some way and/or reinstallation at the same level of professionalism as we use. In fact we, supply the film companies with the local, professional art handlers who are likely the same people who
installed it in the first place (particularly for 2-D wall art).
If it is for a large sculpture that cannot be moved, they must get the approval of the artist or other copyright holder. We have had rare instances where the artist is deceased, there is no estate of record and
no next of kin can be identified, so in those cases, we the City will authorize the use in the production with full credit to the artist. Should someone come forward and claim copyright, then we are able to say that we supported the film company with their
due diligence and welcome any updated information for our records.

Subject: Public Art Use in Film Productions?
Hi All – Does anyone have any experience with film productions shooting around their public art collections?
Is it necessary for film productions to get permission from the artist and/or from the municipality/province/state as the artwork owner to use a public artwork in their film? Would they be required to credit the work/artist
at the end of the film?
My provincial colleague is asking about a large public artwork owned by the province that will be included in scenes shot near our Law Courts building.
