Hi Tamara,

It could ultimately depend on what your commission agreement with the artist requires, but normally, yes, you need to seek permission of the artist.  At the very least, making sure the artist is informed so that you don’t have a surprised and outraged artist coming to you with concerns!

Is it necessary for film productions to get permission from the artist and/or from the municipality/province/state as the artwork owner to use a public artwork in their film? Would they be required to credit the work/artist at the end of the film?

 

My provincial colleague is asking about a large public artwork owned by the province that will be included in scenes shot near our Law Courts building.
