Dear Tamara,
This comes up often in Austin – we require that the production company get permission from the artist(s) for the use of the artwork, particularly if it is for a commercial venture, and require that they attribute the work to the artist and to the commissioning agency (City of Austin Art in Public Places Program).
The artist may work out a fee for the permission to film the artwork, they may grant permission outright, or they may withhold permission, as they see fit. Our program does not get involved in this conversation, beyond letting the artist know that we have been contacted, and getting the artist’s permission to provide their contact information to the production company.

Subject: Public Art Use in Film Productions?
Hi All – Does anyone have any experience with film productions shooting around their public art collections?
Is it necessary for film productions to get permission from the artist and/or from the municipality/province/state as the artwork owner to use a public artwork in their film? Would they be required to credit the work/artist at the end of the film?
My provincial colleague is asking about a large public artwork owned by the province that will be included in scenes shot near our Law Courts building.
