In my former position in charge of the Town of Huntington (Long Island) Public Art program, I was successful in getting the Town Attorney's Office to routinely waive the requirement for liability coverage for low budget projects that clearly didn't offer an artist fee sufficient to cover both their involvement and the additional cost of obtaining liability coverage (e.g. $1,000 honorarium for temporary installations in Town Parks that were often existing artworks on loan from the artist).  Frankly, I was amazed that the waiver was granted, but without it none of these installations would have happened as participating artists already had to waive the Town's liability for any damage or loss associated with loan of the artwork.  Worker's Comp waivers have also been routine, although they now require filing of a formal Certification of Attestation of Exemption with the NYS Dept. of Labor declaring under oath that the artist has no employees.  However, neither of these insurance requirements are written in the Town Code; they are merely the standard policy of the Town Attorney's Office and thus can be waived at the discretion of that official, particularly if there is support from a member or members of the Town Council.

I’ve had the help of Lee Snelgrove in Columbia, SC who said their arts council, One Columbia, enters their insurance policy number on their zoning department’s temporary encroachment form.  Our board of directors might not support that for a project we’re not actually managing, being done by a bunch of volunteers.

 

I hate to break the news to these knitters that they might need to insure themselves, but maybe that’s the answer.

 

Does anyone have advice?  I thank you.
